TERMS OF SALE


Subject

These General Conditions concern the purchase of products made remotely via telematic network on the website www.perlageorvieto.com belonging to Perlage Orvieto s.n.c. with headquarters in Orvieto (TR) piazza Marconi n.1, tax code and VAT number 01521490555.

Such purchases are reserved for final consumer customers (that is, a natural person who purchases the goods for purposes not related to their professional activity), thus excluding subjects such as merchants, wholesalers, resellers, professionals, etc. who intend to resell the related products to third parties.

Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of privacy, will be subject to the regulations set forth in Legislative Decree no. 196/2003 and subsequent amendments.

Acceptance of the general terms and conditions of sale

The Customer, by electronically sending the confirmation of their purchase order, unconditionally accepts and undertakes to observe, in their dealings with Perlage Orvieto s.n.c., the general conditions of sale and payment set out below, declaring that they have read and accepted all the information provided to them pursuant to the aforementioned regulations, also acknowledging that Perlage s.n.c. itself does not consider itself bound by different conditions unless previously agreed in writing.

Customer commitments

These General Terms and Conditions of Online Sale must be reviewed by Customers visiting the website www.perlageorvieto.com before they confirm their purchases. Therefore, submitting the order confirmation implies full knowledge of these General Terms and Conditions of Sale and their complete acceptance.

The Customer undertakes and agrees to provide correct and truthful data and, once the online purchase procedure has been completed, to print and keep these general terms and conditions of sale, already viewed and accepted during the purchase process carried out, in order to fully comply with the requirements of Articles 3 and 4 of Legislative Decree no. 185/1999.

Purchase methods

www.perlageorvieto.com  is a website for the sale of food and wine products, gift items, and editorial products related to gastronomy and the culinary arts in general.

The purchase of products, available as illustrated in the respective descriptive and technical sheets, is made by the Customer at the prices indicated therein, to be confirmed at the time the order confirmation is sent, in addition to the transport costs displayed at the time of purchase and automatically calculated based on the actual weight and volumetric size of the packaging used.

Before confirming the purchase, the Customer will be provided with a summary of the unit cost of each selected product, the total cost in case of purchasing multiple products, and the related shipping costs.

By confirming the purchase, upon completion of the transaction, the Customer will receive an email containing the date and total amount of their order as well as its details.

For orders over 20 kg, it is not possible to complete the purchase directly and the Customer will be contacted by Perla Orvieto s.n.c. to define the terms of fulfillment.

Payments

Payment for the purchased products and the related shipping costs must be made by the customer at the time of submitting the order confirmation, using Visa or Cartasì credit cards or by advance bank transfer in favor of:

The online transaction will take place through Cassa di Risparmio di Orvieto.

For payments made by credit card, user data is transmitted encrypted using the SSL (Secure Socket Layer) system directly to the server of Cassa di Risparmio di Orvieto, which guarantees the security of data transmission according to current banking procedures.

Orders paid by bank transfer will be processed only after the bank confirms that the payment has been made.

Orders from abroad can only be paid by credit card.

Product delivery

Orders will only be processed when the goods are fully available. If the ordered goods are not fully available, upon the Customer's request, a partial shipment of the order may be made; in this case, however, the Customer will be charged the shipping costs for each requested shipment of goods.

The purchased products will be delivered by Perlage Orvieto s.n.c. to the address indicated by the Customer via express courier.

The couriers used will not make advance phone calls nor handle requests for deliveries at specific times. They will make the first delivery without prior notice. In case of the Customer's absence, a notice will be left and a new delivery will be attempted within the following 24 hours. If the Customer is absent again, another notice will be left and the customer must contact the courier to arrange the delivery details. If this attempt is also unsuccessful, the goods will be returned to Perlage Orvieto s.n.c. with the consequent cancellation of the order and nothing will be refunded to the Customer. In this case, Perlage Orvieto s.n.c. reserves the right to charge the Customer's credit card for any additional shipping costs for the return of the goods.

Each shipment will contain a detail of the products sent.

Pursuant to current regulations, Perlage Orvieto s.n.c. is not required to issue any fiscal document for the online sale of its products. However, it will still issue a regular receipt and, upon specific request from the interested party, to be made at the time of the order and accompanied by all necessary information, it will issue a regular invoice and send it together with the goods.

Deliveries for payments made by credit card, and barring unforeseen circumstances beyond our control, will generally follow this schedule: within 72 hours from the order for Italy, within 10 days for Europe and the rest of the world.

Deliveries for payments made by bank transfer, and barring unforeseen circumstances beyond our control, will generally follow this schedule: within 72 hours from the bank's notification of payment for Italy, within 10 days for Europe and the rest of the world.

Orders received on Friday, Saturday, and Sunday will be processed the following Tuesday.

At the time of delivery of the goods by the courier, the Customer is required to check:

  • that the number of packages delivered matches what is stated in the delivery document,
  • that the packages are intact, not damaged, nor wet or otherwise altered, including the sealing materials (paper, adhesive tape, string).

Any damages or discrepancies in the number of packages must be immediately reported to the courier making the delivery by writing "accepted with reservation" on the appropriate delivery document and confirmed, within 3 days, by email to: perlageorvieto@gmail.com.

Only after such verification should the Customer accept the delivery, after which they will not be able to raise any objections regarding the quantity of packages and the external characteristics of what has been delivered to them.

If, on the other hand, the goods received do not correspond to those ordered, any discrepancies found must be reported within two days of receipt by email to: perlageorvieto@gmail.com.

International shipping

For orders coming from outside Italy, any customs fees are to be considered the responsibility of the recipient.

Shipping to USA, Canada and America

Due to FDA restrictions on the import of food and wine products, we are unable to ship our food products to the USA, Canada, the Caribbean, Central America, and South America.

Warranties and defective products

In the event that the Customer finds any deterioration or defects in the material received, they must notify us within two days of receipt, by email to: perlageorvieto@gmail.com.

Any report beyond the aforementioned deadlines cannot be taken into consideration.

Right of withdrawal

The Customer has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within 10 days of receiving the products. The withdrawal must be made by sending a registered letter with return receipt to Perlage Orvieto s.n.c. Piazza Marconi n.1, 05018 Orvieto (TR), in which the intention to withdraw from the contract entered into must be explicitly stated, and at the same time (to the same address), the purchased goods must be returned in a sealed package and in their original packaging. Cash on delivery or freight collect parcels will not be accepted under any circumstances. The costs of returning the products will be entirely borne by the Customer.  Perlage Orvieto s.n.c. will refund, within 30 days from the date it becomes aware of the Customer's exercise of the right of withdrawal, the full price paid net of shipping costs.

The right of withdrawal is reserved only for natural persons, that is, private consumers who act for purposes unrelated to their profession.

The right of withdrawal applies only to goods that are intact at the time of return and cannot be exercised for products which by their nature cannot be returned or are liable to deteriorate or expire rapidly.

Order cancellation by Perlage Orvieto s.n.c.

Perlage Orvieto s.n.c. reserves the right to not accept or to cancel an order received or an item included in the order itself, if the following circumstances occur:

  • out-of-catalog items are ordered,
  • items no longer in production or distribution are ordered,
  • credit card fraud,

Jurisdiction and Competent Court

Any dispute relating to the application, execution, interpretation, and violation of the purchase contract is subject to Italian jurisdiction and the Court of Terni shall have exclusive competence, without prejudice to the mandatory jurisdiction of courts provided for by law.

Right of access to personal data and other rights

With reference to the regulations set forth in Legislative Decree 196/2003 (so-called "privacy code"), the following is communicated:

1. The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her exist, even if not yet recorded, and to receive such data in an intelligible form.

2. The data subject has the right to obtain the indication of:

a) of the origin of the personal data;

b) of the purposes of the processing;

c) of the logic applied in the case of processing carried out with the aid of electronic tools;

d) the identification details of the data controller, the data processors, and the representative designated pursuant to Article 5, paragraph 2;

e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of it as designated representative in the territory of the state, as data controllers or processors.

3. The data subject has the right to obtain:

a) the updating, rectification or, when interested, integration of the data;

b) the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is necessary in relation to the purposes for which the data were collected or subsequently processed;

c) certification that the operations referred to in letters a) and b) have been brought to the attention, including with regard to their content, of those to whom the data have been communicated or disclosed, except in cases where this proves impossible or involves the use of means that are manifestly disproportionate to the right protected.

4. The data subject has the right to object, in whole or in part:

a) for legitimate reasons to the processing of personal data concerning him or her, even if pertinent to the purpose of the collection;

b) to the processing of personal data concerning him/her for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication.
